Acceptance of Terms
By downloading, installing, or using the Wamome application or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms form a legally binding agreement between you and Wamome Ltd ("Wamome", "we", "us", "our"), a company registered in Ireland.
Eligibility
You must be at least 13 years of age to use Wamome. If you are between 13 and 18 years old, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements.
Wamome is not available to individuals who have been previously banned from the Service or in jurisdictions where it is prohibited by law.
Your Account
To use Wamome, you must create an account by verifying a valid phone number. You are responsible for:
- Keeping your account credentials secure
- All activity that occurs under your account
- Notifying us promptly if you believe your account has been compromised
- Not sharing your account with others
You may only register one account per phone number. Creating multiple accounts to evade a ban or restriction violates these Terms.
The Service
Wamome provides a private messaging platform including text messaging, voice and video calls, file sharing, and related features. The Service is provided on an "as is" and "as available" basis. We reserve the right to:
- Modify, suspend, or discontinue any feature of the Service at any time
- Set limits on storage, usage, or functionality
- Introduce new features, which will also be subject to these Terms
We will make reasonable efforts to provide advance notice of significant changes that affect users.
Acceptable Use
You agree not to use Wamome to:
- Send spam, unsolicited commercial messages, or chain messages
- Harass, threaten, abuse, or harm other users
- Distribute malware, viruses, or malicious code
- Violate the privacy or intellectual property rights of others
- Share illegal content including child sexual abuse material (CSAM)
- Engage in fraud, impersonation, or deception
- Attempt to reverse-engineer, scrape, or exploit the Service
- Circumvent or disable security or encryption features
- Facilitate or encourage others to do any of the above
We take abuse seriously. Violations may result in immediate account suspension or termination, and may be reported to law enforcement where required by law.
Your Content
You own the content you send through Wamome. Your messages are end-to-end encrypted — we cannot read them. By using the Service, you grant Wamome only the narrow technical license necessary to route your encrypted messages to recipients. We claim no broader rights over your content.
You are solely responsible for the content you send. You represent that you have all necessary rights to share content through the Service and that your content does not violate any law or these Terms.
Intellectual Property
The Wamome name, logo, app design, and all associated intellectual property are owned by Wamome Ltd. You may not use our trademarks, brand, or visual identity without prior written consent.
Open-source components used in the Wamome application are subject to their respective licenses, which are listed in our in-app acknowledgements.
Privacy
Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which are incorporated by reference into these Terms. Please review them carefully.
Termination
By you
You can delete your account at any time within the app. Deletion removes your account and triggers deletion of your stored account data within 30 days.
By us
We may suspend or terminate your account if we determine, in our reasonable judgment, that you have violated these Terms. For serious violations (illegal content, severe harassment), termination may be immediate without prior notice. For other violations, we will typically provide a warning first.
After termination, you lose the right to access the Service. Sections of these Terms that should survive termination by nature (e.g., liability disclaimers, intellectual property) remain in effect.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WAMOME DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
While we implement strong encryption and security practices, no system is infallible. You are responsible for maintaining the security of your own device.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAMOME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WAMOME'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO WAMOME IN THE 12 MONTHS PRIOR TO THE CLAIM (IF ANY).
Some jurisdictions do not allow certain liability exclusions, so the above may not apply fully in your jurisdiction.
Governing Law and Disputes
These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Dublin, Ireland.
If you are a consumer resident in the EU, you also have the right to use the EU's Online Dispute Resolution platform at ec.europa.eu/odr.
Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify you via the app or email at least 30 days in advance where possible. Your continued use of the Service after changes take effect constitutes acceptance.
If you do not agree with updated Terms, you should stop using the Service and delete your account.
